Miss K Norde brought a claim for unpaid wages against Nationwide Renewables Ltd. The tribunal heard evidence from the claimant only; the respondent gave no witness evidence and produced no documents. The issues were whether the claimant was an employee or worker, whether she had been underpaid during her employment, and what sums remained due.

The tribunal found that, although the claimant signed a contract for services, the label did not reflect the true agreement between the parties. It accepted her evidence that her manager regularly checked in on her and her team, monitored progress, and offered guidance on sales targets. The respondent also used a tracking system for sales, and the claimant was given equipment, including computers, microphones, headsets, and a company email address. The tribunal concluded that she was at least a worker and therefore entitled to bring a wages claim.

On the wage claim itself, the tribunal accepted that £519.75 was due for July 2023 and noted that the respondent accepted that sum. For August 2023, the tribunal accepted the claimant's evidence, including SDR tracker spreadsheets, tables of hours worked between 1 and 16 August 2023, and qualifying callbacks, and found on the balance of probabilities that she had worked 33.25 hours at £10.50 per hour, producing a further £349.13. Judgment was therefore entered for unpaid wages totalling £868.88.
