Tribunal's reasoningMr J Edgar brought claims for notice pay and holiday pay against Black Sheep Brewery Plc. The tribunal recorded that he had been employed for a very short time as group financial controller and that matters were not working out, with the employment ending on 22 November 2022. The tribunal noted that the claimant said at the termination meeting that he had been agreed two months' notice pay, but that this conflicted with his own evidence that he was invited to continue working through the notice period and replied that he did not want to work there for two months after what had been said.
On the notice pay claim, the tribunal found that the respondent's termination letter of 22 November 2022 made clear that if the claimant chose to leave with immediate effect he would not be paid his notice period, and that there was no evidence from the claimant or otherwise to substantiate any contractual right to pay in lieu of notice. The tribunal therefore held that there was no case to answer and dismissed the notice pay claim.
On holiday pay, the tribunal recorded that the claimant had claimed six days' holiday pay but had been paid eight days' holiday pay on or about 25 January 2023. The claim was withdrawn during the hearing on the basis that he had already received the monies due and more, and it was dismissed upon withdrawal.
