This was a public preliminary hearing before Employment Judge Shepherd in Leeds on 6 November 2023. The issue determined was whether the claimant had a disability within section 6 of the Equality Act 2010 at the material time, and, if so, whether the respondents had the necessary knowledge of that disability.

The tribunal decided that Mr K Riley did not have a disability as defined by section 6 at the material time. On that basis, the preliminary disability issue was resolved against the claimant.

The tribunal further found that, in those circumstances, neither the first respondent nor the second respondent had knowledge, or could reasonably have been expected to have knowledge, of a disability. No remedy was recorded in the judgment.
