Tribunal's reasoningMr Gharib was employed by Proud Publishing Limited from 13 November 2019 until 8 January 2020. He brought a claim received on 3 February 2020 saying that he had not been paid wages for the period 10 December 2020 to 10 January 2020. The respondent appointed a voluntary liquidator on 11 March 2020 and did not present a response, so the tribunal considered the matter under Rule 21.
After asking for further information, the tribunal received a payslip for the pay period 11/12/2019 to 10/01/2020 showing net pay of £932.59. Mr Gharib said he disputed the hours and rate of pay on the payslip, but he provided no further evidence about those issues. Judge Stout was satisfied that a determination could be made on the claim under Rule 21(2) and found that the claimant was owed the sum shown on the payslip, but had not proved entitlement to any different amount.
The default judgment therefore ordered Proud Publishing Limited to pay £932.59 to Mr Gharib within 14 days of the judgment being sent to the parties. The judgment was sent on 11 May 2020.
