Tribunal's reasoningThe claimant applied to become a Special Constable with the respondent and was made a conditional offer subject to checks including medical and vetting checks. After he failed vetting, an Occupational Health appointment was cancelled. The respondent had conceded that the claimant was disabled by reason of Asperger's syndrome and Bipolar Affective Disorder, and the claim concerned an alleged failure to make reasonable adjustments in relation to the cancellation of that appointment while the vetting appeal was ongoing.
The tribunal found that the claimant had no reasonable prospect of showing that an Occupational Health referral before the appeal would have affected the ultimate vetting decision. It noted that vetting had failed on grounds including association with others and matters relating to the claimant's own history, the King's Cross incident, and social media posts, and concluded that even with greater understanding of the claimant's disability the chance of passing vetting was very small. The tribunal also found the claim outside the primary time limit, but would have extended time on just and equitable grounds if limitation had been the only barrier; the claim was struck out because it had no reasonable prospect of success.
