The tribunal held that the claimant's complaint of unlawful deduction from wages under s13 and s23 ERA 1996 was well founded. It recorded that the hearing had previously been listed before Employment Judge Norris on 26 June 2023, that the respondent did not attend the 14 August 2023 hearing, and that the respondent had emailed on 8 August 2023 saying it understood the outstanding wages of £579.50 had been paid. The claimant said no payment had been received and that the banking details in the respondent's email were correct, so judgment was entered for the unpaid wages.

The tribunal then considered whether to make an additional award under s24(2) ERA 1996. It found that the respondent had kept the claimant out of her wages since the June hearing and had had the benefit of those wages for about a year. The claimant had found new employment in November 2022 and had relied on family support in the interim. The tribunal assessed further compensation for financial loss at £133.73, equivalent to one week's net pay, producing a total judgment sum of £713.23.
