Tribunal's reasoningThe claimant presented a claim on 14 May 2019 after early conciliation, and at the hearing he explained that he was not seeking any monetary order. He said he had entered into a settlement agreement with the respondent and had been paid sums under that agreement, including an ex-gratia payment, a notice payment and a holiday payment, made on or around 8 April 2019 after his employment ended on 20 March 2019.
The issue determined by the tribunal was whether the payslip issued for the pay period ending 25 April 2019 complied with section 8 of the Employment Rights Act 1996. The claimant said the payslip did not show the payments he had received that month and did not show the amount or purpose of deductions, including tax and NI deductions.
The tribunal found that the copy of the payslip provided by the claimant did not show the payments made on or around 8 April 2019. It therefore held that the payslip did not comply with section 8 of the Employment Rights Act 1996 and made a declaration to that effect under section 12(3). No monetary award was made because the claimant was not seeking payment from the tribunal.
