The Tribunal heard the claimant in person via CVP with a Spanish interpreter. The respondent had presented no ET3, did not attend and was not entitled to take part in the hearing. The Tribunal found that the claimant had two years' continuous service as an employee of the respondent.

The claim of unfair dismissal was well-founded. The basic award was £1,092 (two weeks' pay at £546). The claim for unlawful deductions from wages was also well-founded. The claimant was owed 394 hours at £13.00 per hour gross (£5,122), uplifted by 25% under the ACAS Code to £6,402.50 (the claimant had grieved about the unpaid wages but received no response). The total judgment payment due is £28,197 gross, of which £21,684 is taxable through the normal payroll under PAYE.
