Mr S Lasdas brought direct race discrimination complaints against Vanquis Bank Plc and Rethink Group Ltd. At an Open Preliminary Hearing on 20 February 2020, Employment Judge Khan Date granted the respondents' applications for deposit orders because each complaint was considered to require a deposit as a condition of proceeding. The claimant was ordered to pay £250 for each complaint, totalling £500.

The Record of the Open Preliminary Hearing was sent on 6 March 2020 and the Deposit Order was sent on 1 May 2020, with a 21-day deadline for payment. The claimant wrote to ask for more time, saying he had received the explanatory note later, and the tribunal extended the deadline by 14 days from 18 May 2020 to 1 June 2020. He was reminded that failure to pay by that date would result in the complaints being struck out.

The claimant sent a cheque for the deposits by Signed For First Class post on 27 May 2020, but it was received by the HMCTS Finance Support Centre only on 8 June 2020. The tribunal therefore found that the deposits had not been paid on time. Under rule 39(4) of the Employment Tribunals Rules of Procedure 2013, the complaints of direct race discrimination against both respondents were struck out, and the hearing listed for 25 June 2020 would not take place.
