Tribunal's reasoningThe tribunal found that the respondent increased the claimant's hourly rate from £10.50 to £13.00 at a meeting on 25 March 2022, at the claimant's request, and that the increase was to be reflected by bonus because the claimant was due to leave on 18 April 2022. The claimant worked 78.75 hours to 13 April 2022, and the tribunal found that the respondent underpaid him by not providing a bonus reflecting the £13.00 rate. The tribunal ordered payment of £140.34, calculated as £1,023.75 minus £883.41, subject to PAYE deductions for tax and NI.
The tribunal also found that two days' holiday pay had been paid into the claimant's bank account by the date of the hearing, so no further leave remained outstanding. It nevertheless found an underpayment for holiday leave paid on 6 February 2023 and ordered payment of £30, calculated as £161.20 minus £130.20, again subject to PAYE deductions. In addition, the tribunal found that the respondent should have reimbursed £102.24 for uniform because the uniform had been returned, and it ordered repayment of that deduction.
The claimant's request for interest failed because the Employment Tribunal had no jurisdiction to award interest on the claim. The tribunal recorded the total sum owed by the respondent as £272.58 and permitted an amendment before the hearing so that the uniform deduction could be included once the claimant became aware of it.
