Mrs R Kumbharati v Network Rail Infrastructure Limited RECONSIDERATION OF — 2020

The claimant applied for reconsideration of case management orders and deposit orders made on 27 November 2019. The tribunal did not deal with the case management orders because they were not judgments capable of review, but considered the application in relation to the deposit orders.

The tribunal refused the application, finding no reasonable prospect that the original decision would be varied or revoked. It stated that the claimant had not identified evidence linking the alleged treatment to race or sex, had failed to show that her grievance or any other matter was a protected act for victimisation, and that even accepting her point about safe reporting did not change the assessment of the public interest disclosure claim.
