Tribunal's reasoningThe tribunal found that during the period 25 March 2021 to 4 May 2022 the claimant's employer was Project FZ Ltd. The claim against Seasondream PLC was dismissed. The tribunal also said it had no jurisdiction to consider the claimant's complaints that Project FZ Ltd had not paid her NI and income tax deductions to HMRC and had not paid pension deductions to NEST.
The claim under s.13 of the Employment Rights Act 1996 for unauthorised deductions from wages against Project FZ Ltd was well founded. The tribunal awarded the claimant £1,236.48 in total, made up of £747.43 for unpaid wages and statutory sick pay for 18 March 2022 to 4 May 2022, and £489.05 for five days of annual leave accrued but untaken as at 4 May 2022.
The tribunal further made a declaration under s.12(3)(a) of the Employment Rights Act 1996 that Project FZ Ltd had failed to give the claimant pay statements in accordance with s.8 of the Employment Rights Act 1996 for the periods covered by the award. The claimant attended in person and confirmed she was content to proceed without an Italian translator.
