The tribunal found that the Claimant's second period of employment ran from 1 November 2019 to 31 August 2020, and it rejected the Respondent's jurisdiction argument based on an earlier end date. It accepted that the Claimant had remained employed until the end of August 2020, including because the Respondent issued a P45 showing a leaving date of 31 August 2020, so the claim presented on 11 November 2020 was in time.

On the merits, the dispute was whether wage sums shown on payslips for 30 March, 30 April, 30 May and 30 June 2020 had been paid to the Claimant. The Respondent said those sums had been paid in cash, but the tribunal rejected that account. It found the Claimant's evidence more consistent, noted that the cash-payment explanation appeared late, and treated the absence of corroborating evidence, including the missing CCTV material and the failure to call Mr Anthony Reid, as weighing against the Respondent.

The tribunal also noted anomalies in the documentary record, including inconsistencies between the payslips, the bank statements, and the P45. Having rejected the Respondent's evidence that the four sums had been paid in cash, it concluded that the Claimant had not received the wages shown on those payslips and awarded her the total of £1,926.06.
