Tribunal's reasoningMr A Vosoughifard started work for Newmire Holdings Ltd on 16 August 2021 as an HR Assistant. His contract provided for a salary of £26,000 per year (£500 per week) plus £199 per week for use of his personal equipment because he was required to work remotely. He chose to be paid weekly and says he was not paid the correct wages during the employment.
On 9 September 2021 he received a bank message saying that there had been 'fraud money' transferred into his account by the respondent. He reported that to his manager and then to the police. He resigned on 9 September 2021 with one week's notice and claimed £2,634.66, said to cover notice pay, expenses, a £300 week 4 bonus and £199 work equipment expenses. The respondent did not submit a response and did not appear. The tribunal was initially unsure about service, obtained email addresses from the claimant, emailed them, and received no reply. On the claimant's evidence on solemn affirmation, the tribunal was satisfied that the amount claimed was lawfully due.
The tribunal explained that it could not award the claimant three months' rent or the CIPD cancellation fee in a breach of contract or wages claim because those sums were not due under the employment contract. It therefore entered judgment for £2,634.66 only, and noted that enforcement against the company remained to be seen.
