The tribunal made a judgment by consent under Rule 64 after reading the parties' joint application. It recorded that, in relation to the claimants named in the attached schedule, the respondent failed to adequately comply with section 188 of the Trade Union and Labour Relations (Consolidation) Act 1992, and that the claims for a protective award under section 189 of that Act succeeded.

The tribunal ordered the respondent to pay the sums listed in the schedule to the named claimants in respect of a protected period of 56 days beginning on 29 June 2020, the date on which the first of the dismissals to which the complaints related took effect. The individual awards ranged from £3,680.62 to £4,304.00, and the total of the scheduled awards was £92,768.01.

The judgment also stated that, subject to the normal categories of preferential debts in Schedule 6 of the Insolvency Act 1986, any amounts payable by the respondent rather than the Secretary of State would be treated as an unsecured claim against the respondent's estate and would rank for dividend with ordinary unsecured creditors under the Insolvency Act 1986 and the Insolvency (England and Wales) Rules 2016. The tribunal made no order as to costs, with each party bearing its own costs.
