The tribunal reviewed the file and noted that the claimant had not responded to the tribunal as directed by Employment Judge Burns on 9 February 2024. It also noted a complete absence of activity in relation to the claim by both parties. The judgment records that, on 9 February 2024, it had already been observed that the first respondent was in compulsory liquidation and that the claimant had not obtained permission from the insolvency court to pursue the claim at that time.

On that basis, Employment Judge Forde concluded that the claimant had failed to indicate whether she intended to continue or withdraw the claim, had not informed the tribunal that she had the insolvency court permission required to pursue the claim, and had not demonstrated any intention to pursue it further. The tribunal therefore struck out the claim with immediate effect and dismissed it. The judgment also states that it appeared the tribunal did not have jurisdiction against the first respondent because the claimant had not shown that she had obtained the necessary permission from the insolvency court while the respondent was in compulsory liquidation.
