Tribunal's reasoningThe Tribunal granted the Respondent an extension of time to present a Response. It accepted that the claim papers had not in fact reached the Respondent because the business had moved address and the postal forwarding arrangement had been suspended, and it allowed the late ET3 so that the Respondent's position could be heard at the same hearing.
On the substantive money claim, the Claimant had worked for the Respondent from 11 October 2021 to 18 October 2022 in Direct Product Delivery and had contractually earned £101,474.32 gross during that period. The Tribunal found that £63,141.00 gross remained unpaid, together with £213.38 in unreimbursed expenses. The Respondent, through Mr Temperley, told the Tribunal that it did not wish to defend the claim and admitted that those sums were owing, although it said it was unable to pay at present because it was awaiting investment monies.
The Tribunal therefore found the claim well-founded and ordered the Respondent to pay the sums set out in paragraph 2 of the judgment. The judgment records that the expenses figure claimed in the ET1, £290.00, was varied by agreement to £213.38. No staged payment plan was included in the judgment because the timing of any investment receipt was uncertain.
