Tribunal's reasoningThe claimant worked for the respondent as a junior graphic designer from 1 November 2021 under a written contract signed on 7 October 2021, providing for salary of £25,500 gross per year and 25 days' holiday plus public holidays. The tribunal recorded that he was paid for the first three months, but from 1 February 2022 there was no further pay and no payslips, and that he continued to chase payment while the respondent did not present a response and did not attend the hearing.
On the claimant's evidence, the tribunal was satisfied that he had not been paid the sums contractually due. It found the wages claim under section 23 of the Employment Rights Act 1996 well-founded. The tribunal calculated four months' unpaid gross salary at £8,500 and 12 days' holiday pay at £1,176.92 gross, giving a gross total of £9,676.92. After allowing for tax and National Insurance, it ordered payment of £7,726.23 net.
The redundancy pay claim failed because the claimant did not have the requisite period of two years' service. No other remedy was awarded.
