Claimant v Bauporte Doors UK Limited — 2023

The claimant brought a complaint under section 23 of the Employment Rights Act 1996 alleging unlawful deductions from wages within the meaning of section 13. The respondent did not present a response and did not appear at the hearing. The claimant attended in person, gave evidence on oath, and relied on his contract of employment, WhatsApp messages with his line manager, and an email from the payroll company setting out calculations of wages due and paid.

The tribunal found that the claimant started work on 5 September 2022, was paid for September 2022 ten days late on 10 October 2022, and was not paid anything after that date. The payroll email set out salary payments due for September, October, November and December 2022, recorded an amount already paid of £3,477.32, and identified an outstanding balance of £8,086.94. The claimant did not pursue expenses, saying they had been met from his float.

On that evidence, the tribunal was satisfied that the claimant was entitled to unpaid wages in the net sum of £8,086.94 and entered judgment accordingly. The judgment records that the respondent should account to HMRC for lawful deductions for tax and National Insurance on the amount ordered. No separate remedy beyond the wage award was recorded.
