Tribunal's reasoningThe tribunal found that Ms Hudson was not an employee for the purposes of section 230(1) ERA 1996, but that she was in employment within section 83 Equality Act 2010 and was a worker within section 230(3)(b) ERA 1996. Those status findings were central to the disposal of the dismissal and contract claims.
The unfair dismissal claim was dismissed because the claimant was not an employee. The claim for wrongful dismissal, notice pay and breach of contract was also dismissed because she was not an employee for the purposes of bringing a claim under the Employment Tribunals Extension of Jurisdiction (England and Wales) Order 1994 SI 1994/1623.
The tribunal also dismissed the discrimination claims. The claims for direct discrimination because of sex and religion under section 13 Equality Act 2010, and indirect discrimination on the grounds of religion under section 19 Equality Act 2010, all failed. No monetary award was made.
