Tribunal's reasoningThe tribunal dealt with the case under Rule 21 after the respondent presented no response and did not attend. Ms F Nunes gave sworn evidence and produced her contract of employment, sample payslips, and messages chasing payment, with the assistance of a Portuguese interpreter. The tribunal noted that the respondent had not answered her claims, despite indicating that it would do so.
The tribunal found that Ms Nunes had been employed as a Specialised Architect from 17 May 2023 on an annual salary of £33,000, equivalent to £2,750 gross per month. It accepted that she had been paid normally for May, June and July 2023, but that in August 2023 she was underpaid by £1,000, and that she was not paid for September or October. It also recorded that on 13 September Antonio Farnesi told her that he could not afford her, and that she resigned on 16 November 2023 after the respondent did not deal with her requests for outstanding salary.
On holiday pay, the tribunal accepted the contractual position that she was entitled to 28 days' holiday per year plus usual bank holidays. As she had worked for six months between 17 May and 16 November 2023, it calculated an entitlement of 16 days' holiday over that period, and found that she had taken none. It therefore awarded payment for 16 days of accrued but untaken holiday pay at £137.50 per day.
The tribunal awarded £10,075 gross in total, made up of £7,875 for unpaid wages and £2,200 for holiday pay. It also noted that it could not order the respondent to issue a P45, although it would be good practice for the respondent to do so.
