On 22 September 2023 his line manager informed him that his employment would not continue and he was given one week's notice, ending his employment on 30 September 2023. Although he received a payslip showing a gross payment of £3,461.54 (net £2,689.32) and a P45, he did not receive the pay itself.
Following early conciliation between 9 and 11 October 2023, the Claimant presented an ET1 on 1 November 2023 for his unpaid wages. The claim was served by post on the Respondent at the address the Claimant provided. The Respondent did not present a Response (ET3) and did not appear at the hearing. Attempts by the tribunal to contact the Respondent at email addresses supplied by the Claimant produced either an out-of-office reply or bounce-backs.
Employment Judge E Burns, sitting alone, was satisfied on the basis of the Claimant's evidence that the sum was owed and entered judgment in his favour, ordering the Respondent to pay £3,461.54 (gross, less any required deductions to be accounted for to HMRC) within 14 days. The judgment notes the Respondent may apply for reconsideration under Rule 71 within 14 days if it was unaware of the claim.
