Tribunal's reasoningThe Claimant worked for the Respondent as a Design Intern between 7 November 2023 and 7 February 2024. She was paid correctly for November and December 2023 but was not paid for January 2024, for the days she worked in February 2024, or for accrued but untaken annual leave on termination. The claim was originally brought against Harrix Group Commercial Limited; by consent the correct Respondent, HRX Design Limited, was substituted, the Claimant's contract having been with that company.
The Tribunal found the claims for unlawful deduction from wages and holiday pay to be well-founded. The Respondent did not deny that the sums were owed. The Respondent's Director said the company had ceased trading and lacked funds, although this was not reflected at Companies House; the Claimant said the Respondent appeared still to be trading. The Judge considered it appropriate to issue judgment forthwith.
Using a daily gross rate of £83.46 (£21,700 divided by 260 working days), the Tribunal calculated 23 working days payable for January 2024, noting that the Respondent's January payslip figure of £1,808.33 gross did not account for January having more working days than an average month, and that the February payslip showing a zero amount was agreed to be wrong. The Respondent was ordered to pay a total gross sum of £2,517.76.
