Tribunal's reasoningMs M Chapman presented a claim for unpaid wages on 21 January 2018. At a preliminary hearing on 15 October 2018, Judge Spencer found that Stewpot’s Nursery Ltd was the proper respondent, but the company had been struck off the register and the claim could not proceed in its then current form.
On 16 October 2018 the Tribunal wrote to the claimant explaining that the company had been dissolved and that the proceedings were stayed unless the company was restored to the register. The claimant was told to inform the Tribunal if she decided to apply for restoration, and that the claim would be reconsidered later if no application was made. After further letters on 6 June 2019 and 30 January 2020 produced no response, the Tribunal struck out the claim on the ground that it was not being actively pursued.
