The Tribunal found that the original reason given for rejection was not correct, because the claimant had stated on the claim form that he did not have an Acas early conciliation number because his employer had already been in touch with Acas.
The Tribunal nevertheless found that the early conciliation exemption relied on did not apply. The claimant's reconsideration application showed that he, rather than the respondent, had contacted Acas about the dispute, and that no early conciliation certificate had yet been issued.
The reconsideration application therefore succeeded, but the decision was varied so that the claim was rejected under Rule 13(2) of the Employment Tribunal Procedure Rules 2024. The Tribunal did not determine the merits of the disability discrimination claim or any whistleblowing complaint.
