Tribunal's reasoningThis was a judgment following reconsideration of the earlier decision dated 18 May 2018. Employment Judge K Andrews revoked paragraph 2 of that judgment and replaced it with a revised position on time limits. The tribunal held that any claims for which time started to run at the effective date of termination had been submitted out of time, but that either it was not reasonably practicable for them to have been presented in time or it was just and equitable to allow them to proceed, so time was extended accordingly.
The tribunal did not determine the time issue for any claims where time started to run before the effective date of termination. It said that issue remained open and would be decided by a future tribunal after hearing the relevant evidence. The judge added an observation that it may assist that future tribunal to approach any such issue as if the claim form had been submitted four days before the end of the three-month period after the effective date of termination. No merits decision or monetary award was made in this judgment.
