Tribunal's reasoningAt a preliminary hearing before Employment Judge R Lewis on 25-26 August 2020, the claimant withdrew all claims against the third and fourth respondents personally, the claims for arrears of pay and holiday pay and failure to provide payslips, all race, religion or belief and sex discrimination claims, and all disability discrimination claims based on any impairment other than PTSD. Those withdrawn claims were dismissed, and the third and fourth respondents were dismissed from the proceedings.
The tribunal struck out the remaining claims except for one claim brought in time, which it did not finally determine in this judgment. It held that the other claims were out of time because it had not been shown that it was not reasonably practicable to bring them in time or that it was just and equitable to extend time, and it found no reasonable prospect of showing that the timely claim formed part of a series of similar acts or a continuing act. In accordance with that order, the second respondent was dismissed from the proceedings and the respondent's application for a deposit order was refused.
