Tribunal's reasoningMs H Ison was employed by Angel Hair UK Limited as a hairstylist from 13 July 2014 until 17 February 2019, when she was dismissed for redundancy. She presented claims on 21 March 2019 against Angel Hair UK Limited and Eva Volfona. At an earlier hearing the tribunal found that Ms Volfona was not the claimant's employer and dismissed her from the proceedings.
At the resumed hearing the remaining respondent asked for an adjournment because County Court proceedings about an alleged overpayment of statutory maternity pay were listed for March 2021. The tribunal refused to adjourn, noting that there had already been delay and that the respondent admitted owing the claimant the tribunal sums, while any claim for overpaid SMP had to be dealt with in the County Court and could not be set off against the tribunal claim.
The tribunal held that the claimant's claims for redundancy payment, six days' holiday pay on termination, and unpaid notice pay were well founded. It ordered payment of £520.32 for redundancy pay, £290.24 for holiday pay, and £195.12 for notice pay.
