Angela Carr Second Claimant: Dawn Hollett Third Claimant: Angela Archer
Key findings
Tribunal's reasoningThe respondent did not present a response and did not attend the hearing. After hearing the claimants' evidence under oath and considering the documents, the tribunal found an unlawful deduction of wages in respect of all three claimants and held that their claims for statutory redundancy pay, unpaid wages, and accrued but untaken holiday pay succeeded. The judgment ordered total payments of £13,390.60 to Angela Carr, £6,044.76 to Dawn Hollett, and £4,700.64 to Angela Archer, making a total award of £24,136.00.
Angela Carr started work at Meadowdene Residential Home on 1 September 1995. She was told in November 2018 that the home was closing at the end of that month, and she agreed to work her 12-week statutory notice period until 30 January 2019. The tribunal accepted bank statements showing regular additional hours and used an average weekly wage of £326.60 net for the 12 weeks before redundancy to calculate redundancy pay of £9,798, together with £2,612.80 net for unpaid wages in December 2018 and January 2019 and £979.80 net for 15 days' holiday pay.
Dawn Hollett started on 8 January 1996 and was told by letter on 1 November 2018 that the home would close on 23 November 2018. She worked through her notice period until 31 January 2019 and had been told the sums due would be paid at the end of February 2019, then in mid-March 2019, but nothing was paid. The tribunal awarded £4,698 redundancy pay, £1,221.48 gross for unpaid wages supported by the December 2018 payslip and the January 2019 hours log, and £125.28 gross for four days' holiday pay. Angela Archer started on 23 June 2008, was told the home was closing on 23 November 2018, and by agreement finished on 23 December 2018. The operative award for her was £3,228.60 redundancy pay, £767.34 gross for wages worked from 3 December to 23 December 2018, and £704.70 gross for 15 days' holiday pay; the reasons section at paragraph 19 states £3,288.60 for redundancy, but the order and total sum use £3,228.60.
