Key findings
Tribunal's reasoningMr R F Khan brought claims described in the judgment as dismissal, detriment for making protected disclosures, and unauthorised deductions from wages. A preliminary hearing took place on 24 November 2023, but the claimant did not attend and did not provide the medical evidence he had been directed to produce.
The tribunal recorded evidence from Mr B Jeddi that the claimant had initially signed a contract of employment dated 10 November 2022, but shortly afterwards asked to work on a self-employed basis for tax reasons. The claimant set up RK Multi Trades Ltd, of which he was the sole director and person with significant control, and wished to retain his own gas registration and not transfer to the respondent or its insurance.
The tribunal accepted that the claimant had expressed a clear preference to operate through his own limited company and found that he was a self-employed contractor rather than a worker or employee. On that basis, the tribunal held that it had no jurisdiction to hear the claims and struck them out in their entirety. No remedy was awarded.

| Whistleblowing | The claim for detriment as a result of making protected disclosures was struck out because the tribunal found the claimant was self-employed and outside the tribunal's jurisdiction. | Struck out | — | — |
| Unlawful deduction from wages | The claim for unauthorised deductions from wages was struck out because the tribunal concluded the claimant was not a worker or employee and therefore the tribunal had no jurisdiction. | Struck out | — | — |

Parties and monetary figures are extracted from the judgment PDF text. Key findings and per-claim outcomes require a second extraction pass that is not yet complete for this case — until then, the primary source linked above is the authoritative record.
