The claim was presented on 2 February 2024. The respondent failed to present a valid response on time, and Employment Judge Tsamados determined the claim under rule 22 of the Employment Tribunal Rules of Procedure. The judgment records that the tribunal could properly determine the claim on that basis.

The tribunal found that the claimant had been dismissed by reason of redundancy and was entitled to a redundancy payment. It calculated the gross weekly pay at £576.92, based on £2,500 per month gross converted to a weekly figure. The claimant’s continuous service ran from 2 January 2002 to 30 November 2023, giving 20 years' service, and her age at the effective date of termination was 53.

Applying the statutory multiplier of 26, the tribunal calculated a gross redundancy entitlement of £14,999.92. It then deducted the redundancy payment already received of £11,538.40, leaving £3,461.52 outstanding. The tribunal ordered the respondent to pay that sum in total.

The judgment also states that the Employment Tribunal does not have jurisdiction to deal with the claimant’s missing pension contributions. It says that matter should be taken up with the pension provider, the Pensions Ombudsman, and/or the Redundancy Payments Service.
