In deciding whether to dismiss the claim, Employment Judge Hart took account of the fact that the claimant had also failed to attend an earlier hearing before Employment Judge Ramsden on 7 June 2023. After that hearing, the claimant was ordered to tell the tribunal by 28 June 2023 why he had not attended and whether he wished to pursue the claim, but no response was received. Having made such enquiries as were practicable about the claimant's absence, the tribunal dismissed the claim under rule 47 of the Employment Tribunals Rules of Procedure 2013.
