The judge refused the application. She recorded that there did not appear to be any material change in the respondent’s position beyond the submission, put colloquially, that “the Judge was wrong”. She said that was not a basis on which to seek reconsideration and that reconsideration is not an opportunity to re-run the application in order to obtain a different decision.
The judge said that if the decision is wrong in law, the respondent’s route is an appeal. She also noted that, because of the time that had passed since the application was made and the absence of a response from the administration, the respondent may already have appealed. The judgment therefore ends with the reconsideration application refused.
