Mr Sami Meqran v Kemp Recruitment Limited — 2023

The claimant, Mr Sami Meqran, failed to attend the preliminary hearing listed for 7 August 2023. The tribunal noted that rule 47 of the Employment Tribunal Rules of Procedure allows dismissal where a party fails to attend or to be represented. It also recorded that there had been no communication from the claimant since the claim was lodged, apart from an email sent on 29 November 2022 saying that he did not think he could make it because he had a lot of commitments during that time of year.

The main complaint in the claim form was that the claimant had not been paid his correct wages for three days worked as a temporary worker in August 2022. The respondent's explanation was that there had been a delay in obtaining the relevant timesheets from the client company and that a final payment was made shortly after the claim form was issued. The claim form also contained brief allegations of harassment or discrimination on grounds of race or religion, but the tribunal said these related to employees at the client company, for whom the respondent was not responsible.

In those circumstances, and taking account of the claimant's non-attendance and the earlier email, the tribunal concluded that there were no outstanding issues which the claimant intended to pursue and dismissed the claim. No remedy was awarded.
