Tribunal's reasoningThe claimant applied for reconsideration of the deposit order made on 17 January 2025. He argued that the strike-out application had already failed, that the deposit order should not have been listed for hearing, that he had been taken by surprise by information first raised in oral submissions, and that the tribunal had misdirected itself on the discrimination evidence, including its reference to the ethnicity of candidates. He also relied on King v Great Britain China Centre and Network Rail Infrastructure Limited v Griffiths-Henry. The tribunal reviewed the file, its notes and the reasons for the original decision, and held that there was no reasonable prospect of the original decision being varied or revoked on those grounds.
The tribunal accepted that there was nothing in the papers showing that the new information had previously been provided to the claimant, but it found that advance service of a skeleton argument would have made little, if any, difference to the outcome. It also rejected the claimant's assertion that REJ Khalil had refused the strike-out application, noting there was no record of that on the file and that the manuscript note concerned only the hearing remaining private. The tribunal concluded that the claimant had not been told how to pay the deposit and that it would be procedurally unfair and contrary to natural justice to penalise him for non-payment in those circumstances, so it varied the order by extending the payment deadline to 14 days after the Tribunal office sends him the payment information.
