At a preliminary hearing in public on 23 July 2025 before Employment Judge Lumby, the tribunal determined whether the claimant was a disabled person for the purposes of section 6 Equality Act 2010. It found that, at the relevant times, she was disabled because of back problems/spinal arthritis. It also found that from 5 November 2022 she was disabled because of a prolapsed bladder, and from 1 November 2023 she was disabled because of a combination of stress, anxiety, depression, unstable angina and high blood pressure.

The tribunal stated that any relevant complaints relating to those disabilities and falling within the relevant time periods could proceed, but that complaints falling outside those time periods were dismissed. It further found that the claimant was not a disabled person as defined by section 6 Equality Act 2010 because of learning disabilities, and complaints relating to learning disabilities were therefore dismissed. No monetary award was made in this preliminary judgment, and written reasons were not provided unless requested.
