Miss Bonney v Mr Lee — 2024

Miss Bonney did not attend the hearing on 19 September 2024, and Mr Lee also did not attend and had not entered a response. The tribunal noted that the same was true of the earlier hearing on 19 February 2024, when case management orders were made by Employment Judge Hanning, but those orders had not been complied with and there had been no correspondence from either party.

The tribunal clerk attempted to contact the claimant on the number given in the ET1, left a voicemail at about 2.05pm, and by 2.30pm there had been no response. In the absence of any explanation for the claimant's failure to attend either hearing, the tribunal considered that reasonable efforts had been made to contact her.

Employment Judge Dyal decided that the appropriate course was to dismiss the claim pursuant to rule 47. The reasons state that, in all the circumstances, it appeared that the claimant had decided to abandon the claim and no longer wished to pursue it. The judgment therefore records a dismissal of the claim and does not contain any award of remedy.
