Tribunal's reasoningMr S Sanders was employed by Westex Limited from 2 April 2012 until 18 September 2019, when he was instantly dismissed on account of redundancy. The respondent did not present an ET3, administrators were appointed and allowed the claim to continue, and the respondent was later dissolved on 6 December 2021.
The tribunal held that, under section 86(1)(b) of the Employment Rights Act 1996, the claimant was entitled to seven weeks' notice of termination. It found that he had received neither notice nor pay in lieu of notice.
Using a weekly pay figure of £476.67, the tribunal calculated notice pay of £3,336.69 and awarded that sum to the claimant.
