Tribunal's reasoningThe claimant was employed by the respondent from 8 April 2019 as a Director and General Manager. He was placed on furlough from 1 April 2020 on a reduced salary of £3,500 per calendar month and remained on furlough until the scheme ended at the end of September 2021. The tribunal accepted his evidence, in the respondent's absence, that after furlough ended he was unable to access work systems and repeatedly sought information about his work, pay and future with the respondent without receiving substantive responses.
The tribunal found that the claimant continued to receive reduced wages for a prolonged period and repeatedly chased late payments and updates from Mr Binney. The judgment records partial non-payment of wages between 1 June 2022 and 1 February 2024, calculated as 21 months at £1,500 per month gross, and non-payment in full for February to May 2024, calculated as 4 months at £5,000 per month gross.
The tribunal awarded the claimant the net unpaid wage sums claimed: £17,884.02 for the partial non-payment period and £13,791.91 for the full non-payment period, making a grand total award of £31,675.93 net of tax.
