Ms S Adeoye Mr C Ajala v Alliance Recruitment Consultants Limited and 1 other — 2021

Ms Adeoye and Mr Ajala were employed by Alliance Recruitment Consultants Ltd as support workers/healthcare assistants. Ms Adeoye worked from 26 August 2020 to 23 September 2020, including two sleepover shifts, and Mr Ajala worked from 6 September 2020 to 15 September 2020. Both worked at the Qualified Care Residential Care Home in Coulsdon.

The tribunal consolidated the claims and, after checking Companies House records, found that Alliance Recruitment Consultants Ltd had been dissolved but that the business had continued trading under later company names. It also found links between the named directors and the address at which the claimants worked. The tribunal amended the first respondent’s name and added Esther Serwah as a second respondent in Mr Ajala’s claim.

On the evidence of the two claimants, and in the absence of any information from the respondents, the tribunal found on the balance of probabilities that both claimants were owed unpaid wages. It held that those claims were well founded and ordered payment of £2,209.00 to Ms Adeoye and £466.46 to Mr Ajala.

The tribunal recorded that the sums were gross and that the claimants must account to HMRC separately in relation to the award.
