Tribunal's reasoningMrs A-M Flower brought a complaint of unfair dismissal against the Secretary of State for Business and Trade and Bishop Challoner School (in voluntary liquidation). Section 108 of the Employment Rights Act 1996 requires a claimant to have not less than two years' service to make an unfair dismissal complaint, and the Tribunal recorded that the claimant was employed by the Second Respondent for less than two years.
The claimant had been given the opportunity to give an acceptable reason why the complaint should not be struck out and had not done so. Employment Judge Ramsden accordingly struck out the unfair dismissal complaint. The judgment expressly states that the claimant's other complaints are not affected by this judgment.
