Key findings
Tribunal's reasoningThe Tribunal held that Ms A Conteh’s complaints of unfair dismissal and wrongful dismissal were well founded. It found that Transforming Support (South London) Limited had unreasonably failed to comply with the ACAS Code of Practice on Disciplinary and Grievance Procedures and increased the relevant awards by 10% under section 207A of the Trade Union and Labour Relations (Consolidation) Act 1992.
The Tribunal also found that Ms Conteh’s blameworthy conduct contributed to her dismissal. It reduced the unfair-dismissal basic and compensatory awards by 50% under sections 122(2) and 123(6) of the Employment Rights Act 1996 respectively.
For wrongful dismissal, the Tribunal awarded a net £2,749.44, comprising uplifted notice pay of £2,664.60 and uplifted pension contributions of £84.84. For unfair dismissal, it awarded a £1,211.30 basic award, £275 for loss of statutory rights, and a £5,774.31 compensatory award for loss of earnings and pension contributions. The total net award was £10,010.05.
The Employment Protection (Recoupment of Benefits) Regulations 1996 applied to the section 123 award. The prescribed element was £5,774.31, attributable to 17 September 2024 to 12 February 2025, and the total award exceeded that element by £4,235.74.
