Tribunal's reasoningThe Tribunal recorded that the claimants listed in the attached schedule were employed by the respondent and were dismissed by reason of redundancy on 17 October 2019. It also recorded that on 28 October 2019 Sarah Helen Bell and Stephen Gerard Clancy of Duff and Phelps were appointed joint administrators of the respondent.
The Tribunal found that the respondent did not inform and consult the claimants in accordance with ss.188 and 188A of the Trade Union and Labour Relations (Consolidation) Act 1992. The claimants therefore brought a complaint under s.189 seeking a protective award. The Tribunal declared the claims well founded.
The Tribunal made a protective award in favour of the description of employees dismissed within 90 days of 17 October 2019. It ordered the respondent to pay remuneration for a protected period of 8 weeks from 17 October 2019, and recorded that the protective award would rank as an unsecured claim against the joint administrators.
