Key findings
Tribunal's reasoningThe respondent did not present a response, and Employment Judge Ainscough determined the matter under rule 21 on the information before the tribunal. In the judgment dated 17 February 2021, the tribunal found that Adelphi Insurance Brokers Ltd had failed to pay the first claimant, Mrs A Cotterill, compensation for accrued annual leave on termination and contractual notice pay, and had failed to pay the second claimant, Mrs N Unsworth, the same two categories of sums.
The first claimant was awarded £465.44 gross for accrued annual leave under regulation 14 of the Working Time Regulations 1998 and £846.16 gross for notice pay under the contract of employment. The second claimant was awarded £1,444.25 gross for accrued annual leave and £807.70 gross for notice pay. The tribunal also stated that section 26 of the Employment Rights Act 1996 limits unlawful deduction from wages claims to wages payable to the worker and excludes any payment to a pension provider. The total award was £3,563.55 gross.
