Mr R. Mckenzie v Be Sure Group — 2022

The claimant, Mr R. Mckenzie, brought a claim for unlawful deductions from wages against Be Sure Group Ltd. The respondent did not present a response within the time limit and did not appear at the hearing, which was heard by video on 8 June 2022 before Employment Judge Callan. The tribunal said it was satisfied that the claim could be determined on the basis of the claimant's documents, which included the conditional offer of employment, payslips for December 2021 and January 2022, the company's vehicle policy, personal equipment issue documents, and email exchanges between the parties from 1 February to 9 February 2022.

The tribunal upheld the unlawful deduction claim and ordered the respondent to pay £1,992.28 gross. It found that £451.90 gross was due for 5 days' accrued holiday pay in the period 18/10/2021 to 21/01/2022 and remained unpaid on termination of employment. It also found £1,265.38 gross was due as wages for the period 02/01/2022 to 31/01/2022.

A further £275 gross was found to have been unlawfully deducted from pay due on 31 December 2021. The written notice also stated that sums payable under the judgment would carry interest if not paid within 14 days after the decision was sent, with the relevant decision day recorded as 24 June 2022 and the stipulated rate of interest as 8%.
