The Tribunal considered the preliminary issue of whether the claim was in time. It treated early August 2020 as the limitation starting point, accepted that it was not reasonably practicable for Miss Seddon to start early conciliation within the primary period because of exceptional personal circumstances, but found that she had not presented the claim within a further reasonable period.
The Tribunal concluded that the claim form presented on 10 April 2024 was out of time and that the test for an extension was not met. It also took account of evidential difficulties for the respondent arising from the delay, and dismissed the claim for lack of jurisdiction without determining the substantive merits.
