In its late response filed on 31 July 2025, the respondent agreed it owed the claimant £1,941.71 in unpaid wages. The respondent also raised a jurisdictional time-limit point, contending the claim had been presented out of time.
Employment Judge KM Ross found there was no time-limit issue. The wages were due on 28 January 2024 and primary limitation expired on 27 April 2024. The claimant contacted ACAS on 12 March 2024 and the early conciliation certificate was issued on 16 April 2024, giving him the benefit of the 'stop the clock' extension of 35 days, taking the deadline to 1 June 2024. The claim was presented on 29 April 2024 and was therefore in time.
Given the respondent did not contest the sum owed, the judge issued judgment under Rule 22 of the ET Rules of Procedure 2024 ordering the respondent to pay the claimant £1,941.71 in unpaid wages within 14 days. The claimant's separate claim for disability discrimination is unaffected by this judgment and will proceed to a final hearing on 29 May 2026.
