Tribunal's reasoningMr Steel applied by letter dated 17 June 2023 for further reconsideration of the reconsideration judgment sent on 9 June 2023. He said the reconsideration hearing should never have happened and alleged that the respondent had lied during that hearing about why she had delayed presenting her response and reconsideration application.
Employment Judge Horne held that the tribunal should have followed rule 72(1) by setting a time limit for the claimant's written response before listing a reconsideration hearing, but said that the irregularity did not create any reasonable prospect of the reconsideration judgment being varied or revoked. The claimant's email of 28 April 2023 had effectively set out the response he would have made, and the judge remained satisfied that a hearing was necessary because there was a dispute about whether the claimant had been given notice of termination.
The judge also rejected the claimant's complaint about alleged lies. He said the point was not sufficiently relevant, and in any event the claimant could have raised it at the reconsideration hearing. The judge found the respondent's account capable of belief and consistent with her emails to the tribunal. The application for further reconsideration was therefore refused.
