Mrs D Bennett v Knowsley Travel Limited — 2020

The hearing took place at Liverpool on 13 February 2020 before Employment Judge Buzzard. The respondent's name was amended from "Knowsley Travel" to "Knowsley Travel Limited". The respondent was represented by Mrs K Russell, Company Director; the claimant did not attend.

The tribunal recorded that attempts were made to contact the claimant on the morning of the hearing without success, and no explanation for her absence had been received at or before the hearing. The file showed that the hearing date had been confirmed to the claimant in a notice sent on 7 November 2019, and after the claimant enquired on 6 February 2020 this was reconfirmed by email on 11 February 2020. The tribunal waited until 10:20am before taking action.

In those circumstances, and because there had been no communication from the claimant about her non-attendance, the tribunal dismissed all of her claims pursuant to rule 47 of the Employment Tribunals Rules of Procedure 2013. The judgment does not contain any substantive findings on the merits of the underlying unfair dismissal, unlawful deduction from wages, or working time claims.
