Tribunal's reasoningThe tribunal struck out the claimant's claim under rule 37 of the Employment Tribunal Rules of Procedure 2013 because it had not been actively pursued. The reasons recorded were that the claimant had not complied with a request to provide an ACAS certificate number, had not attended a hearing on 10 October 2019, and had not responded to tribunal correspondence.
By letter dated 15 January 2020, the claimant was warned that the claim might be struck out. He was given until 22 January 2020 to make written representations or request a hearing, but no representations or request was received. On that basis, the tribunal ordered that the claim be struck out.
The tribunal added that, in any event, it would have been required to reject the claim under rule 12 of the 2013 Rules because the claim form did not contain an ACAS certificate number.
